Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by LaunchReach.ai ("LaunchReach," "we," "us," or "our"), located at 2371 McDonald Ave, Brooklyn, NY 11229. By creating an account, purchasing a subscription, connecting an email account, or otherwise using LaunchReach, you agree to these Terms.

1. Eligibility and Authority

You must be legally able to enter into these Terms. If you use LaunchReach on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. LaunchReach Service

LaunchReach provides business outreach tools that may include campaign creation, AI-assisted personalization, mailbox connections, sending controls, inbox management, CRM functionality, reply classification, analytics, deliverability tools, mailbox ramping, and related features.

Features may change over time. Some features may be offered as beta, preview, or experimental functionality and may be modified or discontinued.

3. Accounts and Security

You are responsible for maintaining accurate account information and protecting your login credentials. You are responsible for activity performed through your account and for promptly notifying us if you believe your account or a connected mailbox has been compromised.

4. Connected Email and Third-Party Accounts

You may connect third-party accounts, including Google/Gmail and other email providers, to LaunchReach. By connecting an account, you authorize LaunchReach to access and use the permissions you grant solely to provide the features you request, subject to our Privacy Policy.

You must have the right to connect each account and send from each mailbox. Your use of connected services remains subject to the applicable third-party provider's terms, policies, sending limits, and acceptable-use rules.

5. Acceptable Use and Outreach Compliance

You may use LaunchReach only for lawful purposes. You are solely responsible for your audience, source of lead data, message content, legal basis or consent where required, opt-out handling, and compliance with applicable laws and provider policies.

You may not use LaunchReach to:

• Send unlawful, deceptive, fraudulent, harassing, abusive, or misleading communications.
• Send messages to recipients when you lack any legally required permission, consent, or lawful basis.
• Ignore valid unsubscribe, opt-out, or suppression requests.
• Impersonate another person or organization or misrepresent sender identity.
• Distribute malware, phishing content, credential-stealing content, or other harmful code.
• Attempt to bypass provider security systems, rate limits, abuse controls, or authentication requirements.
• Use LaunchReach for prohibited or unlawful goods, services, or activities.
• Probe, reverse engineer, disrupt, overload, or interfere with LaunchReach or another user's account, except where such restriction is prohibited by law.

We may restrict or suspend sending or account access when necessary to protect recipients, connected providers, LaunchReach infrastructure, or other customers.

6. Deliverability and Mailbox Ramp Features

Deliverability features, sending limits, mailbox ramping, bounce monitoring, and related recommendations are tools only and do not guarantee inbox placement, sender reputation, delivery, replies, or business results. Email providers independently determine filtering, rate limits, suspensions, and account eligibility.

7. AI-Assisted Features

LaunchReach may provide AI-generated drafts, personalization, classifications, suggested replies, summaries, and related outputs. AI output may be incomplete, inaccurate, or inappropriate for a particular recipient. You are responsible for reviewing AI-generated content before use unless you deliberately enable an automated mode.

When you enable automated AI reply functionality, you authorize LaunchReach to generate and send eligible responses under the settings you configure. You remain responsible for those settings, recipient communications, and legal compliance.

8. Customer Data

You retain ownership of the data and content you submit to LaunchReach. You grant LaunchReach a limited right to host, process, transmit, reproduce, and otherwise use that data as necessary to provide, secure, support, and improve the service and as described in our Privacy Policy.

You represent that you have all rights and permissions necessary for the data you upload or process through LaunchReach.

9. Subscriptions, Trials, and Billing

Paid features may be offered through recurring subscription plans. Pricing, plan limits, trial duration, billing frequency, and applicable charges are shown before checkout.

If you begin a free trial that requires a payment method, your subscription may automatically convert to a paid subscription at the end of the trial unless you cancel before the trial ends. By starting such a trial, you authorize the applicable recurring charge disclosed at checkout.

Unless otherwise stated, subscription fees are billed in advance and are non-refundable except where required by law. We may change pricing or plan features prospectively with reasonable notice where required.

10. Usage Limits

Plans may include limits on stored leads, new leads, connected mailboxes, AI usage, team members, sending capacity, or other features. We may enforce these limits technically. Attempts to circumvent plan or platform limits may result in restriction or suspension.

11. Intellectual Property

LaunchReach and its software, design, branding, documentation, and service technology are owned by LaunchReach or its licensors and are protected by applicable intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are transferred to you.

12. Feedback

If you provide suggestions or feedback about LaunchReach, you authorize us to use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

13. Third-Party Services

LaunchReach depends on third-party services such as cloud hosting, email providers, payment processors, transactional email providers, and AI service providers. We are not responsible for outages, policy changes, suspensions, data practices, or failures caused by third-party services outside our reasonable control.

14. Suspension and Termination

You may stop using LaunchReach at any time. We may suspend or terminate access if you materially violate these Terms, fail to pay amounts due, create security or abuse risk, violate provider requirements, or use the service in a way that may harm recipients, third parties, LaunchReach, or connected infrastructure.

Upon termination, your right to use LaunchReach ends. Certain provisions that by their nature should survive termination will continue to apply, including payment obligations, intellectual property provisions, disclaimers, limitations of liability, and dispute-related provisions.

15. Disclaimers

LaunchReach is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant uninterrupted availability, guaranteed delivery, inbox placement, campaign performance, revenue, replies, or compatibility with every third-party provider.

LaunchReach does not provide legal advice. Product features, templates, compliance tools, or recommendations do not replace advice from qualified legal counsel regarding your specific outreach activities.

16. Limitation of Liability

To the maximum extent permitted by law, LaunchReach and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities arising from or related to your use of the service.

To the maximum extent permitted by law, LaunchReach's aggregate liability arising out of or relating to the service or these Terms will not exceed the amount you paid to LaunchReach for the service during the three months immediately preceding the event giving rise to the claim.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold LaunchReach harmless from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the service, your campaign content or recipient data, your violation of these Terms, or your violation of another person's rights.

18. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Where legally required, we will provide additional notice of material changes.
